The rules are now stricter than ever, and even a single glass of wine or beer could land you in serious trouble.

In March 2025, the Spanish Congress gave the green light to a proposal from the Socialist Party (PSOE) to reduce the legal alcohol limit for drivers. The measure, still going through its final stages of approval, is expected to come into force soon and will apply across the country—including Ibiza. For tourists, especially those used to more relaxed limits back home, understanding the new rules is essential.

What is the new legal limit?

The proposed law will lower the maximum permitted blood alcohol concentration (BAC) from 0.5 grams per litre to 0.2 grams per litre, or from 0.25 mg/l to 0.1 mg/l in exhaled air. In practical terms, this means that most people will not be able to consume any alcohol at all before driving without exceeding the limit.

To illustrate:

  • A man weighing between 70 and 90 kilograms may test positive after drinking as little as one-third of a beer.
  • A woman weighing between 50 and 70 kilograms could exceed the limit after just a single glass of wine.

This is a significant reduction, bringing Spain in line with countries such as Sweden and Norway, which already operate under similar limits.

Why have the drink-driving rules changed?

The initiative is part of a wider effort to improve road safety across Spain. The National Institute of Toxicology recently reported that 33% of drivers killed in road accidents in Spain had alcohol in their system, as did 29% of pedestrians who died after being hit by a vehicle. These figures have alarmed policymakers and led to stronger measures to reduce alcohol-related incidents on the roads.

Spanish MP Manuel Arribas, speaking in favour of the bill, said it was about saving lives and preventing tragedies. He called on fellow lawmakers to vote with “responsibility” and consider “the mothers and fathers who today will not be able to hug their children again”.

What are the penalties?

The new law also introduces a tiered system of penalties, depending on how much alcohol is detected in the driver’s system:

1. Minor offences

  • Between 0.1 mg/l and 0.25 mg/l of air, or 0.21 g/l and 0.50 g/l in blood
  • Fine: €200
  • Points: loss of 2 points on the Spanish driving licence system. While tourists may not have a Spanish licence, serious infractions are still recorded and can lead to penalties in your home country or a driving ban within Spain.

2. Moderate offences

  • Between 0.26 mg/l and 0.50 mg/l of air, or 0.51 g/l to 1 g/l in blood
  • Fine: €500
  • Points: loss of 4 points

3. Serious offences

  • Over 0.50 mg/l of air or over 1 g/l in blood
  • Fine: €1,000
  • Points: loss of 6 points

4. Criminal offences

  • Above 0.60 mg/l in air or 1.2 g/l in blood
  • Considered a criminal offence
  • Potential penalties:
  • 3 to 6 months in prison
  • A fine of 6 to 12 months
  • 30 to 90 days of community service
  • Driving ban from 1 to 4 years

These punishments apply equally to locals and foreign drivers. If you’re caught over the limit, you may face immediate sanctions, including the immobilisation of your vehicle and possible arrest.

What about Social Media?

The proposal also includes a ban on publishing or sharing the locations of alcohol or drug checkpoints on social media. This means that if you spot a police control while out and about in Ibiza, you should not post about it on Instagram or WhatsApp. Doing so could lead to legal consequences.

How does this affect tourists in Ibiza?

Ibiza may be best known for its party scene, but many visitors also rent cars or scooters to explore the island’s stunning beaches, rural towns, and natural landscapes. If you’re planning to drive at any point during your trip, it’s important to approach alcohol with extreme caution—or avoid it altogether.

Spanish traffic laws apply to everyone on the road, regardless of nationality. If you’re found to be over the limit:

  • You may be fined on the spot
  • You could be banned from driving in Spain
  • Your offence may be reported to authorities in your home country

Many car rental companies in Ibiza will also charge additional fees or withhold deposits if their vehicles are impounded due to drink-driving offences.

The safe way to explore Ibiza

With these stricter laws in place, the best advice is simple: don’t drink if you’re driving. Instead:

  • Use taxis or rideshare apps after a night out.
  • Consider staying near nightlife areas if you’re planning to go out drinking.
  • Use public transport when available.
  • Appoint a designated driver within your group who will abstain from alcohol.
